The Outcome
Working with the contractor to discharge conditions and ensure a smooth transition from gaining planning permission to the construction phase. SP&D first focused on those conditions that required discharge prior to commencement of development, working for the landowner whilst the construction tender process was ongoing. We were then novated to the contractor to work directly for them to discharge the remaining conditions.
We made a non-material amendment application to amend the trigger point for some conditions so the information could be submitted later in the process to allow time for the detailed design to progress. Although a number of conditions did not require discharge until installation or even occupation, we wanted to discharge them as soon as possible to remove risk and give cost certainty.
